Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Aphrodite S.L., a company established in Spain (“Aphrodite,” “we,” “us,” or “our”), governing your access to and use of our websites, applications, and services (collectively, the “Services”). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

• You must be at least 21 years old to create an account or use the Services. The Services are strictly for adults.
• You must have the legal capacity to enter into these Terms and not be barred from using the Services under applicable law.
• You may be required to verify your identity and age (see our verification process). We may suspend or refuse access where eligibility cannot be confirmed.
• See our Child Safety Standards for our zero-tolerance position on any content or conduct involving minors.

2. Your Account

• You are responsible for the accuracy of your registration information and for keeping your credentials secure.
• Couple accounts may include details and a login for each partner; the account owner is responsible for all activity on the account.
• You are responsible for all activity that occurs under your account.

3. Acceptable Use

You agree not to:

• Upload, share, or solicit any content that sexualizes, endangers, or involves a minor — this is strictly prohibited and reported to authorities.
• Harass, threaten, impersonate, defraud, or invade the privacy of others, or share another person’s intimate images or personal data without consent.
• Post unlawful, non-consensual, hateful, or abusive content, or content you do not have the rights to share.
• Use the Services for commercial solicitation, spam, scraping, or to circumvent security, verification, or membership limits.
• Attempt to access accounts, data, or systems you are not authorised to access.

We may remove content and suspend or terminate accounts that violate these Terms or our safety standards. Report violations in-app or to aphrodite@aphrodite.is.

4. User Content and Licence

You retain ownership of content you submit. You grant Aphrodite a limited, worldwide, non-exclusive licence to host, store, process, and display your content solely to operate and provide the Services to you and the users you choose to share it with. This licence ends when you delete the content or your account, except for copies retained as required by law or for legitimate safety/audit purposes as described in our Privacy Policy.

5. Memberships, Payments, and Refunds

• Some features require a paid membership (silver, gold, or platinum). Pricing, billing cycle, and included features are shown at the point of purchase.
• Subscriptions are processed by Stripe and renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period.
• Where you sell tickets, run a club/venue, or receive payouts, partner payouts are handled via Stripe Connect and are subject to Stripe’s terms in addition to these Terms.
• Prices are shown in euro (EUR) unless stated otherwise at the point of purchase.
• EU/UK 14-day right of withdrawal: Consumers resident in the EU or UK have a 14-day right to withdraw from a purchase. However, by starting to use a paid digital feature during this period you expressly request that we begin immediately and acknowledge that you lose your right of withdrawal once the service has been fully provided; if it has only been partly provided, you may withdraw and we will refund a pro-rata amount. [Legal: pair this waiver with an explicit acknowledgement at checkout for it to be valid in the EU.]
• Except where required by law, payments are non-refundable. To request a refund, contact aphrodite@aphrodite.is.

6. Suspension and Termination

You may delete your account at any time from Account settings (see also Delete Account). We may suspend or terminate access, with or without notice, where we reasonably believe you have breached these Terms, created risk or legal exposure, or where required by law. On termination, your right to use the Services ends; provisions that by their nature should survive (e.g., licences for retained records, liability limits, governing law) survive.

7. Disclaimers

The Services are provided “as is” and “as available.” Aphrodite does not guarantee the conduct of any user. You are responsible for your own safety when interacting with others, online and in person. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Services is limited to the greater of (a) the total amounts you paid to us in the 12 months before the event giving rise to the claim, or (b) EUR 100 [TO BE COMPLETED BY LEGAL: confirm cap amount]. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law, including for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or — for EU/UK consumers — any statutory rights or liability that may not lawfully be excluded.

9. Governing Law and Disputes

These Terms are governed by the laws of Spain, without regard to its conflict-of-law rules. The courts of Málaga, Spain have exclusive jurisdiction, except that consumers resident in the EU or UK retain the protection of the mandatory provisions of the law of their country of residence and may bring proceedings there. EU consumers may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

10. Changes to These Terms

We may update these Terms to reflect changes to the Services or the law. We will post the updated Terms here and revise the “Last updated” date; where changes are material, we will provide reasonable notice. Your continued use after changes take effect constitutes acceptance.
